Disputes

Any controversy or claim arising out of or relating to this site or the content or materials on this site shall be settled by confidential arbitration administered by and conducted in the Portland, Oregon office of the United States Arbitration and Mediation under its applicable Rules of Arbitration. The arbitrator’s decision shall be final and legally binding and judgment may be entered in any court having jurisdiction. Each party shall be responsible for its share of the arbitration fees in accordance with the applicable Rules of Arbitration. In the event a party fails to proceed with arbitration, unsuccessfully challenges the arbitrator’s award, or fails to comply with the arbitrator’s award, the other party is entitled to costs of suit, including reasonable attorneys’ fees for having to compel arbitration or defend or enforce the award. To the fullest extent permitted by applicable law, no arbitration under this agreement shall be joined to an arbitration involving any other party subject to this agreement, whether through class arbitration proceedings or otherwise. In the event you violate or threaten to violate any intellectual property right of idtcenter.org or cause or threaten to cause any other significant and irreparable harm, you hereby consent to The Center’s application to a court of competent jurisdiction for injunctive or other equitable relief to restrain such act or threat of action, without prejudice to any other relief in law or equity otherwise available to The Center.

Changes

The Center reserves the right to make changes to this agreement and any other policies posted on this site at any time without notice. Such changes shall be effective when posted. Your continued use of this site after any such changes have been posted will be deemed complete and unconditional acceptance of those changes. The Center reserves the right to terminate or change any aspect of this site, including the availability of any features on this site, at any time without notice. Entire Agreement, Severability, and Waiver

This agreement contains the entire understanding between the parties relating to its subject matter.
